Terms of Service
Effective October 17, 2026 · Updated October 24, 2026: added the terms for paid plans (section 7), which apply once paid plans launch
These terms are an agreement between you and Scotty Limbaugh, who runs BackstockTCG from Arkansas, United States ("BackstockTCG", "we", "us"). They cover your use of backstocktcg.com, app.backstocktcg.com, store pages, kiosks and order boards, and related services (the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy.
- You must be 13 or older. Keep your password safe; you're responsible for what happens on your account.
- Your cards, prices and records are yours. We just host them so the Service can work.
- Stores are responsible for their own prices, sales, buy-ins and dealings with customers. BackstockTCG isn't part of those transactions.
- Card information and market prices come from other sources and can be wrong. Check before relying on them.
- BackstockTCG is in early access and provided "as is". Use it fairly and lawfully.
- Paid plans renew automatically until you cancel. Cancel any time and keep Premium until the end of the period you've paid for. Payments aren't refunded.
1. Who can use BackstockTCG
- You must be at least 13 years old. If you're under 18, you need a parent or guardian's permission, and they agree to these terms for you.
- If you use BackstockTCG for a store or business, you confirm you're allowed to accept these terms on its behalf.
2. Your account
- Give accurate information, and keep your email address current so you can recover your account.
- Keep your password secure and don't share your account. You're responsible for activity on it. Tell us straight away if you think someone else has used it.
- Store owners and managers control their store's team accounts, roles and settings, and are responsible for who they give access to.
3. Stores, customers and transactions
- BackstockTCG is a tool. Stores set their own prices, offers, buy-in rates and policies, and they alone are responsible for their sales, purchases, trades, refunds, taxes and the condition and authenticity of cards.
- BackstockTCG doesn't buy, sell or hold cards or money, and isn't a party to any transaction between a store and its customers.
- Pull requests, order updates and calendars help stores and customers communicate. A request isn't a guaranteed sale; availability and prices are confirmed by the store.
- Stores must have their customers' consent for the information they enter about them, such as names on buy-ins, and must handle it lawfully.
4. Your content
- You keep ownership of everything you add: inventory, photos, messages, events and other content ("your content").
- You give us permission to store, process, display and send your content only as needed to provide the Service, for example showing your stock on your public page when you turn it on.
- You confirm you have the right to upload your content, and that it doesn't break the law or anyone's rights.
5. Acceptable use
Don't use the Service to:
- break the law, or help anyone else do so, including selling counterfeit or stolen cards;
- harass, threaten or abuse anyone, or post hateful, sexual or violent content in chat or anywhere else;
- send spam, or misuse order emails or other messages;
- access accounts or data that aren't yours, probe or break our security, or overload the Service;
- scrape, copy or resell the Service or its data, other than exporting your own content;
- impersonate a person, store or brand.
6. Card data, prices and trademarks
- Card names, images, details and market prices come from third parties, including Scryfall and TCGplayer. They're provided for reference, can be incomplete, out of date or wrong, and aren't advice on what to charge or pay.
- Scanning and picture matching identify cards automatically and can make mistakes. Check what's added.
- Magic: The Gathering, Pokémon, One Piece, Disney Lorcana, Riftbound, Cyberpunk, Union Arena, Gundam, Dragon Ball and other names and images belong to their owners. BackstockTCG isn't affiliated with or endorsed by them.
7. Plans, billing and cancellation
- Early access. Until paid plans launch, every feature is free. We'll tell you before any fees start, and nothing is ever charged without you agreeing to a price first. The rest of this section applies once paid plans are offered.
- Plans. BackstockTCG has a free plan and paid plans. Collector Premium covers your own collection. Store Premium covers a store and its team, and also includes Collector Premium for the owner's own collection. Collector Premium doesn't include store features. Paid plans are monthly or yearly subscriptions, or a one-time Lifetime purchase when it's offered. What each plan includes is shown in the app under Profile → Your plan.
- Store plans are bought by the store's owner and cover everyone working at that store.
- Prices and tax. The price is shown before you pay. Sales tax or similar taxes are added where they apply. Payments are processed by Stripe; your card details go to Stripe and never reach BackstockTCG.
- Free trial. You can start one 2-week free trial per account. A card is needed to start it. When the trial ends, it turns into the paid plan you chose and your card is charged, unless you cancel before the trial ends.
- Automatic renewal. Subscriptions renew automatically at the end of each month or year, and your card is charged the price in effect at that time, until you cancel. If a price goes up, we'll tell you before it applies; the new price starts at your next renewal, and you can cancel before then.
- Cancelling. You can cancel any time in Profile → Your plan → Manage billing. You keep Premium until the end of the period you've already paid for, then your account moves to the free plan. Nothing you've added is deleted; Premium-only features stop working until you subscribe again.
- No refunds. Payments are non-refundable, including for unused time in a period, for a renewal you didn't cancel in time, and for Lifetime purchases, except where the law requires a refund.
- Failed payments. If a renewal payment fails, we and Stripe will try again and let you know. If it still can't be collected, your account moves to the free plan.
- Lifetime. Lifetime is a one-time payment for Premium for as long as BackstockTCG offers the Service. It's for the Service's life, not yours, and it isn't transferable. If BackstockTCG ever closes, we'll give as much notice as we reasonably can.
- Deleting your account cancels any subscription straight away. It isn't refunded.
- Plans given to early-access testers as a thank-you, or set by us, may differ from the above; we'll tell you if yours does.
8. Availability and changes
- We work to keep BackstockTCG running and your data safe, but we can't promise it will always be available, uninterrupted or error-free. Keep your own copies of important records (for example with the CSV and TCGplayer exports).
- We may add, change or remove features. If a change significantly affects you, we'll give notice where we reasonably can.
9. Ending your account
- You can delete your account at any time in Profile, under Edit profile & settings. What's deleted is explained in our Privacy Policy. Deleting it cancels any paid plan (see section 7).
- We may suspend or close accounts that break these terms or put other users or the Service at risk. Where reasonable, we'll warn you first and give you a chance to export your content.
10. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of card data or prices, and non-infringement.
11. Limitation of liability
To the fullest extent the law allows, BackstockTCG and Scotty Limbaugh won't be liable for indirect, incidental, special or consequential damages, or for lost profits, sales, data or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim, or $50.
Some places don't allow these limits, so they may not all apply to you.
12. Indemnity
If your content, your store's dealings with customers, or your breach of these terms leads to a claim against us, you agree to cover our reasonable costs of dealing with it.
13. Governing law and disputes
These terms are governed by the laws of the State of Arkansas, United States, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in Arkansas, and you and we agree to their jurisdiction. Before going to court, please contact us so we can try to resolve the problem informally.
14. Changes to these terms
We may update these terms. If we make important changes, we'll update the date above and tell you in the app or by email before they take effect. If you keep using BackstockTCG after that, the new terms apply.
15. General
- These terms and the Privacy Policy are the whole agreement between you and us about the Service.
- If part of these terms can't be enforced, the rest still applies.
- If we don't enforce a term straight away, we can still enforce it later.
